Notice of Energy Independence and Security Act of 2007 Implementation

Connexus Energy (Connexus) hereby gives public notice regarding the process it will follow in implementing the provisions of the Energy Independence and Security Act of 2007 (EISA ’07), which amended the Public Utility Regulatory Policies Act of 1978 (PURPA). EISA ’07 established four new federal standards under Section 111(d) of PURPA that require certain utilities, including Connexus, to consider after public notice and hearing.

The four new PURPA standards defined by EISA ’07 that Connexus must consider are:

  1. Integrated Resource Planning (Sec. 532(a)). Each electric utility shall integrate energy-efficiency resources into its plans and adopt policies establishing cost-effective efficiency as a priority resource. Energy efficiency resources are obtained by providing incentives to retail consumers for the installation of energy-efficient equipment.

  2. Rate Design Modifications to Promote Energy-Efficiency Investments (Sec. 532(a)). Each electric utility shall "align utility incentives with the delivery of cost-effective energy efficiency and promote energy-efficiency investments."

  3. Consideration of Smart Grid Investments (Sec. 1307(a)). Each electric utility shall consider smart grid investments before permitting investments in non-advanced grid technologies. Smart grid is the use of communication and modern computing to operate the electric power grid.

  4. Smart Grid Information (Sec. 1307(a)). All electric customers should be given direct access to information concerning time-based electricity prices in the wholesale market along with available retail rates. Also, all customers should have access to the data concerning the sources of power provided by the utility, including greenhouse gas emissions associated with each type of generation.

Please note that Connexus is required to "consider" adopting these standards. There is no requirement to adopt the standards. However, the consideration and decision must be based on the evidence in the record developed for this consideration, and the rationale for the decision on each standard must be documented in writing.

Written Comments/Questions

Any interested person may submit written comments or questions on potential implementation of the above referenced standards on or before August 24, 2009.

Hearing

The hearing will be held by the Connexus Board of Directors at 14601 Ramsey Blvd., Ramsey, Minnesota on September 24, 2009, at 1:00 p.m. Any interested person may attend and make an oral statement at the hearing. A person need not attend or participate in the hearing for such person’s written comments to be considered.

Final Determination

Connexus Board of Directors will make a determination on the standards on or before December 19, 2009.
